ReachDial Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of services provided by ReachDial ("ReachDial," "we," "us," or "our"). This AUP is incorporated into and is part of ReachDial's Terms of Service. All capitalized terms not defined in this AUP have the meanings given to them in the Terms of Service. Violation of this AUP may result in suspension or termination of your service.
1. Lawful Purposes Only
You may use our Service and your equipment only for lawful, proper, and appropriate purposes. You may not use our Service or your equipment in any way that is illegal, improper, or inappropriate. A non-exhaustive list of examples of illegal, improper, or inappropriate uses includes:
- Interfering with our ability to provide Service to you or other customers, or avoiding your obligation to pay for the Service within the time frame designated for payment.
- Use of the Service to threaten, abuse, harass, defame, deceive, defraud, interfere with, or invade another's privacy or engage in any similar behavior.
- Use our Service or your equipment for: auto-dialing; continuous, repetitive, or extensive call forwarding; telemarketing (including charitable or political solicitation or polling) in violation of applicable laws; fax or voicemail broadcasting or blasting.
- Use our Service or your equipment to: impersonate another person; send bulk unsolicited messages; use robots, data mining techniques, or other automated devices or programs to catalog, download, store, or otherwise reproduce or distribute information from our Service.
- Violate any law, rule, or regulation; violate any third party's intellectual property or personal rights; or exceed your permitted access to our Service.
- Use the Service for transmitting or receiving any communication or material which would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable law.
2. SMS and Text Messaging Prohibited Uses
In addition to the general prohibitions above, you may not use our SMS or text messaging services for:
- Sending unsolicited commercial text messages (SMS spam) or messages that violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or similar laws.
- SMS spoofing or falsifying sender information.
- Sending messages to individuals who have not provided prior express consent or who have opted out of receiving messages.
- Using SMS services in any manner that violates 10DLC (10-Digit Long Code) regulations, mobile carrier requirements, or The Campaign Registry (TCR) rules.
- Sending SMS messages for illegal purposes, including but not limited to phishing (smishing), fraud, harassment, threats, or illegal content distribution.
- Using SMS to distribute malware, viruses, malicious links, or phishing attempts.
- SMS bombing or flooding (sending excessive messages to a single recipient or group).
- Operating SMS short code services or premium SMS services without proper authorization and compliance.
- Any SMS use that damages ReachDial's sender reputation, brand registration, or causes carrier filtering, blocking, or penalties against ReachDial's messaging traffic.
3. AI and Automated Systems Prohibited Uses
You may not use ReachDial's AI-powered features, call analytics, transcription services, sentiment analysis, or other automated systems for:
- Illegal surveillance, unauthorized call recording, or violation of federal or state wiretapping or eavesdropping laws.
- Creating, distributing, or facilitating deepfakes, voice cloning for fraud or impersonation, or synthetic media used for deceptive purposes.
- Processing, analyzing, or storing call data in violation of privacy laws, including GDPR, CCPA, or other applicable regulations.
- Circumventing consent requirements for call recording, monitoring, or analytics.
- Using AI-generated insights, transcriptions, or analytics for illegal discrimination, harassment, profiling, or other unlawful purposes.
- Training third-party AI models, large language models (LLMs), or machine learning systems using data obtained from ReachDial services without authorization.
- Any use that violates applicable AI governance laws, algorithmic accountability regulations, or biometric privacy laws.
4. Cybersecurity Prohibited Uses
You may not:
- Introduce viruses, malware, ransomware, trojans, worms, spyware, adware, or other malicious code into ReachDial's network, infrastructure, or Service.
- Attempt to gain unauthorized access to ReachDial's systems, servers, databases, other customer accounts, network infrastructure, or administrative interfaces.
- Launch, facilitate, or participate in distributed denial-of-service (DDoS) attacks, denial-of-service (DoS) attacks, or any form of network flooding or attack.
- Use the Service for cryptocurrency mining, blockchain validation, or any process that consumes excessive network bandwidth or computing resources.
- Employ packet sniffing, network scanning, port scanning, vulnerability scanning, penetration testing, or other reconnaissance techniques against ReachDial's infrastructure without prior written authorization.
- Bypass, disable, circumvent, or interfere with security features, authentication mechanisms, access controls, encryption, or security monitoring systems.
- Use compromised credentials, stolen authentication tokens, session hijacking, or other unauthorized access methods.
- Engage in any activity that compromises the security, integrity, confidentiality, or availability of ReachDial's Service, network, or customer data.
5. Modern Threat Prohibited Uses
You may not use the Service for:
- Phishing, spear-phishing, vishing (voice phishing), smishing (SMS phishing), social engineering attacks, or pretexting.
- Caller ID spoofing for fraudulent, deceptive, or illegal purposes (legitimate business caller ID display is permitted).
- Operating or facilitating illegal robocall campaigns, predictive dialers without proper consent, or campaigns that violate the TCPA, TRACED Act, or STIR/SHAKEN requirements.
- SIM swapping attacks, SIM hijacking, port-out fraud, or other telecommunications account takeover schemes.
- Business email compromise (BEC) schemes, CEO fraud, invoice fraud, or wire transfer fraud using our communications services.
- Impersonating government agencies, law enforcement, courts, financial institutions, utilities, tech support, or other trusted entities for fraudulent purposes.
- Operating unlicensed gateway operations, SIM box fraud, or GSM gateway fraud to bypass carrier billing or routing.
- International revenue share fraud (IRSF), artificial inflation of traffic (AIT), premium rate service (PRS) fraud, or other toll fraud schemes.
- Swatting, bomb threats, false emergency calls, or other dangerous hoaxes that endanger public safety.
6. Unlimited Voice Services
ReachDial reserves the right to periodically review usage levels of unlimited minute service plans to ensure that you are not using such service in violation of this AUP. You agree to use the unlimited minute service plans for traditional voice or fax calls of a duration comparable to that of the average small to medium business customer. The following types of services are specifically prohibited: conference calling services (as a reseller), monitoring services, continuous data transmissions, transmission of broadcasts, or transmission of recorded material for commercial purposes.
We consider your use of our Unlimited plan to be "unreasonable" if you:
- Re-sell, re-brand, re-supply, re-market, or commercially exploit our Unlimited Service without our written consent.
- Set up routing functionality such that only outbound long-distance traffic is sent over the Unlimited Service.
- Engage in any other conduct which is fraudulent or results in significant network congestion or degradation.
7. Right of Termination
In addition to ReachDial's right to terminate service for nonpayment, ReachDial reserves the right to terminate the Service immediately and without advance notice if ReachDial, in its sole discretion, believes that you have violated any of the above restrictions, leaving you responsible for the full month's charges to the end of the current term, including without limitation unbilled charges, plus a disconnect fee, all of which immediately become due and payable.
8. Monitoring and Enforcement
We may monitor the use of our Service for violations of this AUP and our Terms of Service. We may, without liability, remove or block all communications if we suspect a violation of this AUP, or if we think it necessary in order to protect our Service, or ReachDial, its affiliates, directors, officers, agents, and employees from harm.
If we believe that you have used our Service for an unlawful purpose, we may forward the relevant communication and other information, including your identity, to the appropriate authorities for investigation and prosecution. You consent to our forwarding of any such communications and information to these authorities.
9. Use of Service Outside the United States
Although we encourage you to use our Service to call foreign countries from the United States and to use our Service as you travel, the services are designed to work primarily in the United States. All use of ReachDial Service to or from areas outside the United States is at your own risk and subject to the laws and regulations of the jurisdiction where the Service is used.
10. No Transfer of Service
You may not resell or transfer your Service or provide a telephone service to anyone else by using your ReachDial service or features without first obtaining our prior written consent. This includes operating as an unauthorized telecommunications carrier, reseller, or service provider.
11. No Alterations or Tampering
If you copy, alter, modify, reverse engineer, decompile, or have someone else copy, alter, modify, reverse engineer, or decompile the firmware, software, or configuration of any equipment used with the Service in any way that facilitates a compromise of your service or circumvents usage policies, you are responsible for any charges that result.
12. Theft of Service
You may not use or obtain our Service in any manner that avoids ReachDial policies and procedures. You will notify us immediately in writing if your equipment is stolen or if you believe that your Service is being stolen, fraudulently used, or otherwise being used in an unauthorized manner.
13. Network Management
ReachDial reserves the right to implement reasonable network management practices to ensure the quality and reliability of the Service for all customers. This may include monitoring traffic patterns, implementing quality-of-service (QoS) policies, and taking action to prevent network abuse or degradation.
14. Amendments
ReachDial reserves the right to modify this AUP at any time. The current version of this AUP will be posted at www.reachdial.com. Your continued use of the Service after changes to this AUP constitutes your acceptance of the modified AUP.
